Civil and family law

How do you find the best lawyer in Tehran for a legal matter?

If your issue is dowry or divorce, a cheque that bounced, a contract that turned into a dispute, or a property with no title deed, this page is for you. First, how to recognise a good lawyer; then, what I do in each area. I am Seyed Mahdi Mousavi, a trainee lawyer in Tehran.

Scales of justice and a gavel on a desk with a harbour behind Getting startedBring your documents and we will read them together

Most civil disputes begin with a small misunderstanding or an incomplete piece of paper: a contract with no clear term, a cheque whose date was altered, a sale agreement that never became a title deed.

Before filing a lawsuit there are often cheaper, faster routes: a formal notice, negotiation, arbitration, direct enforcement. My first job is to see which one works for your case.

Areas I work in

A short note on each. For more detail, visit the related articles (mostly in Persian) or call me.

Dowry, alimony, divorce and custody

Mahriyeh (dowry) is a debt from the day of the marriage contract and can be claimed at any time. But the route and sequence you choose to claim it affect time and cost a lot. In divorce and custody, the child's best interests and each side's documents decide.

Bounced cheques, notes and debt claims

For a cheque, the certificate of non-payment and the deadlines are critical; after that, depending on the cheque, you can seek enforcement, file a civil claim, or lodge a criminal complaint.

Drafting and reviewing contracts

Sale, lease, partnership or business cooperation contracts. I focus on obligations, remedies, duration, and the clauses that usually end up in dispute.

Property, sale agreements and title deeds

The new law on registering property deals has changed the position of many informal agreements. We check what route your property has to a proper title deed.

Inheritance and estate division

Identifying heirs, each share and the order of division; and if there is a dispute, the certificate of heirship and a partition claim.

Guardianship and trusteeship

Appointing a guardian or trustee for a child, a sick person or someone legally incapacitated, which has its own steps and paperwork.

Law books and case files on a desk under a lamp

Ask yourself these three questions before filing

Many cases are lost not on the right, but on the choice of route.

  • Do I have evidence, or just words?. A court rules on documents and proof, not on stories. If evidence is thin, the first job is a plan to collect it.
  • Can the other side actually pay?. Winning a ruling is one thing; enforcing it is another. Looking at the other side's assets is part of the decision.
  • Are the cost and time worth it?. Sometimes a settlement or arbitration, even giving up part of your claim, is better than a two-year lawsuit.

Mistakes that make a case harder

Signing a contract without reading the penalty and termination clauses

Most disputes start from the very clauses nobody read seriously.

Buying property on an informal sale agreement

Years later, getting a title deed can run into trouble. Check the registry status before you pay.

Missing the cheque deadlines

The legal deadlines for cheques are short and the certificate of non-payment must be obtained on time.

Sending a formal notice in a rush

The text of a notice can be used against you in court later. Read it once more, or have a legal professional look at it before sending.

What makes the best lawyer in Tehran for legal matters?

A good civil lawyer is not necessarily the loudest one. Check these:

  • Their licence can be verified with the Bar Association or the Judiciary's lawyers' centre.
  • They read the contract, deed, cheque and ruling before giving an opinion.
  • They also raise cheaper options like negotiation and arbitration, not just litigation.
  • They state the fee in writing and clearly.
  • They are honest about the risk and odds of the case and do not guarantee results.
  • They keep you informed throughout.

I would like to be judged by these same standards. If you want, a short call is enough to see whether we are a good fit.

FAQ

Questions people ask me most

How do I find the best lawyer in Tehran for a legal matter?

Skip rankings and advertising and look for signs you can check: a verified licence, a written contract, a lawyer who reads your documents before giving an opinion, and no promises about the result. The fuller list is just above.

From when can dowry be claimed?

Mahriyeh is the husband's obligation from the time of the marriage contract, and the wife can claim it whenever she wants; divorce is not required. The route (enforcement through the registry or the family court) and the husband's finances affect how the case runs, so it is best checked before acting.

My cheque bounced. What do I do first?

Get the certificate of non-payment from the bank on time and do not lose the dates. After that, the right route depends on the type of cheque and the issuer's situation. See the guide on bounced Sayadi cheques (in Persian).

Is an informal sale agreement enough?

An informal agreement has value as proof of purchase, but it is not official ownership. With the new law on registering property deals, the route to a title deed has changed; see the article on registering property transactions (in Persian).

How much do a lawyer and a lawsuit cost?

Court costs and legal fees depend on the type and stage of the case, so no general figure applies. In the first consultation I give an estimate, and if we proceed it is put in writing.

Do you offer phone consultations?

Yes. If you send your documents, many cases can be reviewed by phone.
