Smuggling of goods and currency

Smuggling defense lawyer in Tehran

Smuggling files are full of technical detail: the seizure report, the minutes, the valuation, the clearance papers. A small mistake in any of them can change the charge. Here is how these files get read and where I can help. I am Seyed Mahdi Mousavi, a trainee lawyer in Tehran.

Goods are seized, currency is found in transit, or a company is summoned over a cleared shipment. In that moment most people do not know whether the charge is "smuggling" or a "violation". The difference is more than a term: it affects the authority that hears the case, the penalty and the line of defense.

My work is to read the seizure report and the documents, see what the charge is built on, and find which parts of the file can be challenged.

Where I can help

For individuals and companies, roughly in order of how often they come up:

Reviewing the seizure report and minutes

How the seizure happened, date and place, who was present, and from whom and under what conditions the goods were actually found.

Valuation of goods or currency

Valuation affects the charge and the hearing authority. The basis and the method of calculation can be challenged.

Smuggling versus a violation

Sometimes an act treated as smuggling is really a customs or trade violation. Telling them apart can change the outcome.

Clearance and import documents

The customs permit, invoice, declaration, warehouse receipt and licences are the main tools of defense.

Defense before the tribunal and the court

Depending on value and the charge, the case is heard by the administrative tribunal or the court, and the defense brief differs for each.

Seizure and release of goods

The steps for objecting to a seizure and requesting release, which have strict timing.

Documents, a seal and a magnifying glass on a review desk

Documents to gather early

In smuggling cases, a good document does more for you than any argument.

  • Ownership and purchase records. Invoice, purchase contract, payment receipt, and anything showing the lawful origin of the goods.
  • Customs documents. Permit, declaration, warehouse receipt and clearance papers.
  • Required licences. If importing or moving the goods needed a licence, the licence and its validity dates.
  • Reports and notifications. Keep every notified paper and note the date you received it.

Mistakes that make the case harder

Signing the minutes without reading them

The minutes later become some of the most important evidence. They must be read before signing.

Not explaining the origin of the goods

If you hold lawful documents for the goods, present them early and in order.

Accepting the valuation without checking

The stated value may be flawed, and objecting to it has a time limit.

Handing the matter to a middleman

In government cases a claim to "know someone" not only fails to help, it can create a new case.

Facing a smuggling case? Call before signing or giving a statement

Sometimes advice before your first statement changes the course of the case.

What makes a good smuggling lawyer?

This is a technical field, and the right lawyer should know the law, customs and the practice of the authorities:

  • They read the seizure report and minutes line by line and list the flaws.
  • They explain clearly which authority hears the case and what the deadlines are.
  • Their licence can be verified and they sign a written contract.
  • They do not guarantee a result.
  • They stay responsive and follow the file regularly.

I would like to be judged by these same standards. If you want, a short call is enough to see whether we are a good fit.

FAQ

Questions people ask me most

Do the seizure report and officers' reports matter in a smuggling case?

Yes, these documents are the base of the charge. How the report was drawn up, whether the seizure was carried out properly and whether it complies with the law all carry real weight in the defense.

How does the valuation of goods affect the case?

The value of goods or currency can affect the charge, the hearing authority and the penalty, which is why the basis and accuracy of the valuation matter.

What is the difference between smuggling and a violation?

Some acts that look like smuggling are actually violations and carry different proceedings and consequences. It depends on the details of the act, the type of goods and the documents, and each file has to be checked separately.

Do you only work in Tehran?

My main focus is Tehran, but cases are accepted from across Iran and consultation is by phone.

What should I bring to the first consultation?

Every paper you have received, the seizure report or minutes if they exist, and the purchase and customs documents for the goods. If you have nothing, call anyway and we will list what needs to be collected.
